A track being playable, downloadable or generated by a paid account today does not prove that it is licensed for commercial use. Suno’s help pages make the time of creation central to rights.
Commercial rights attach to the generation context
Suno’s help center says songs created while subscribed to Pro or Premier receive commercial-use rights, subject to its Terms, and that free Basic songs are noncommercial. A subsequent upgrade does not normally apply retroactive rights to previously generated free songs. Record the generation timestamp, active plan, account ownership and a copy or dated reference to the controlling terms for every asset. A single current subscription screenshot cannot substantiate an entire back catalogue.
Commercial-use permission is not copyright certainty
Permission under a platform contract is not the same as a court determining that a generated track enjoys copyright protection. Nor does it settle whether prompts, imported stems or lyrics contain protected third-party material. Record all human contributors and sources; obtain rights to uploaded samples and composition elements independently. Do not tell clients that a paid AI music track is automatically free of infringement claims.
The 2026 download limits are a separate issue
Suno’s September 2026 help pages describe new download allowances for Pro and Premier and restrictions for free accounts. Download eligibility and commercial-use eligibility are distinct. For scheduled releases, confirm that the account has sufficient downloads for masters and stems before promising delivery. Keep the official 2026-era notice available because download rules have changed and may change again.
A safe production workflow
Generate several sketches, shortlist by musical structure and emotional fit, and listen for odd lyrics, repeated phrases and technical defects. Preserve a clean instrumental and stem export if available within the plan. When adapting an existing track, check who owns the starting melody, recording and lyrics; editing an unlicensed source through AI does not cure missing permission.
Where alternatives differ
Stability AI’s Stable Audio knowledge base states different commercial rules, including permission in some free-tier contexts; Google’s Lyria products have their own terms and regional availability. Do not generalize a Suno rule to all music generators. Commercial clients should get a rights memo containing the exact generation system, date, plan and any needed performer or sample licenses.
Worked production example
Suppose a creator produces background music while on Suno Basic in August, then upgrades to Pro and wants to use that same song in a monetized October video. The documented general rule does not automatically transfer commercial rights backward. The creator can instead generate a new eligible work under a qualifying plan, obtain an applicable separate grant if offered or select properly licensed music elsewhere. Merely re-downloading an old file under a paid subscription is not proof that its original license changed.
Practical acceptance gate
Keep a generation ledger with track ID, date, active tier, inputs, contributor permissions, version history and delivery destination. Verify that enough export allowances remain before committing to a client deadline. When a song includes user-supplied vocals or lyrics, analyze those licenses independently. The track may be commercially usable under a platform grant without being independently copyrightable or free from similar protected material. For distribution across countries, ask qualified counsel to review contested rights rather than asserting universal ownership.
Region, plan and model-version notes
Documentation checked on 2026-10-25. Exact applicability: availability varies by account/endpoint and jurisdiction. Version: Suno Basic/Pro/Premier (Oct 2026). Plan: Basic free / Pro / Premier. Monetary prices and quotas are not asserted unless separately verified; check the canonical AI 10 pricing ledger before purchase or publication of a tariff.
