A product can meet a narrow technical benchmark yet be deployed unlawfully. A legal notice can be accurate while the underlying model remains unreliable. Responsible organizations need several independent checks.
Technical risk is about system behavior
Assess wrong outputs, unauthorized actions, adversarial manipulation, unfair errors, operational outages and failure recovery. Test the actual version and workflow under realistic conditions. A NIST-guided assessment can help organize technical evidence but is not a legal compliance certificate.
Privacy asks how information is handled
Record what personal data is collected, the purpose, lawful authority where needed, processing chain, access, retention and deletion. A chatbot might never hallucinate and still leak personal information to an external service. Conversely, private processing does not guarantee correct advice or content rights.
Legal compliance depends on jurisdiction and role
Binding obligations may arise from AI-specific law, existing data protection or consumer rules, copyright, employment, safety or sectoral regulation. The EU AI Act’s timeline differs from Singapore PDPC guidance or the United States FTC’s use of existing consumer-protection authorities. An “internationally compliant” claim is rarely useful without listing countries, products, activities and dates.
Make three sign-offs visible
Require a technical owner to accept measured error and security risk, a privacy owner to approve data handling and a legal or policy owner to review jurisdiction-specific obligations where warranted. One person can hold multiple responsibilities at a small organization, but the questions should stay separate.
Example: voiceover generator
The tool may be technically stable and properly store input files. Its output still could imitate a performer without permission, fail to disclose synthetic content where required or violate music license terms. Evaluate each issue independently rather than assuming “enterprise grade” answers them all.
Decision practice
Maintain evidence links, dated scope, unresolved issues and a rollback trigger. If an obligation is still proposed or under legal dispute, label it as such instead of presenting it as effective global law.
