Brazil has debated a comprehensive artificial intelligence bill, but legislative proposals cannot be treated as enacted statutory duties. The official Chamber file for PL 2338/2023 must be checked before making any 2026 claim.
Track the official parliamentary file
PL 2338/2023 was assigned to a Chamber special committee in April 2025, and the legislature lists further activity through 2026. This is evidence of legislative process, not evidence that every proposed provider duty has become law.
Separate the bill from privacy law
Brazil already has a personal data protection framework under LGPD and regulator ANPD. A proposed AI risk classification should not be copied into production as a legal obligation merely because the bill text contains it.
Avoid invented commencement dates
Bill numbers, substitute texts, committee decisions, plenary votes, presidential assent and official publication are separate milestones. A proposed effective date may never become operative. Provide the exact official current status and the source access date.
What organizations can do now
Map high-impact uses, affected groups, human review rights, training data sources and incident response. These are defensible risk-management controls independent of whether the proposed AI bill passes. Refer to live data protection obligations separately.
Compare actors without conflation
Provider, integrator and deploying employer may face different obligations under any enacted framework. Do not copy EU provider terminology into Brazil without an explicit local definition. Likewise, do not assume that a national proposal pre-empts consumer or sector rules.
Editorial gate
This article is maintained as a dated legislative-status explainer. Before publication, re-open the exact Chamber docket and check any promulgated 2026 law or veto. Never label the bill in force without a promulgation citation.
Publication limitation
Additional verification remains open: Legislative status and all later Chamber actions must be checked on publication day; proposal not enacted based on reviewed dossier. Do not represent this jurisdictional draft as a complete statement of current legal obligations until that review is finished.
Dated first-party verification and limits
The Chamber dossier records referral to a special committee on 29 April 2025 and further September 2026 legislative activity. These are procedural actions, not a promulgation record. For publication, recheck whether the proposal has since passed both houses, been sanctioned and been published in the official gazette; no enacted AI duty is inferred here from the proposal alone.
