Chile’s AI legislative debate matters for planning, but an AI bill in parliamentary consideration is not an enforceable national AI Act.
Identify the legislative text and stage
The Chamber of Deputies docket for bill 16821-19, consolidated with 15869-19, records introduction in May 2024 and later consideration in the Senate. The official procedure in 2026 lists the proposal in the second constitutional stage. A headline saying the measure “passed” may refer to one chamber, committee or vote; always identify the exact parliamentary event.
A proposal is different from existing duties
Organizations handling personal data or offering regulated services may already be subject to other Chilean laws. They should not wait for an AI-specific statute before controlling unauthorized disclosure, data quality or deception. Conversely, compliance checklists should not quote draft AI-bill requirements as if inspectors were already enforcing them.
Prepare without guessing final language
Build an inventory of models, intended uses, affected groups, data origins and documented human oversight. These are useful independent of whether a future Chilean AI law adopts risk categories or obligations resembling another country’s rules. Record which parts of a control are voluntary organizational commitments rather than legal requirements.
How to monitor the law correctly
Follow the chamber’s official procedural record, subsequent Senate amendments, final approval, promulgation and publication. At every checkpoint distinguish the last available text from a law in force and separate commencement dates from publication dates. If materially revised, update article explanations and contract obligations before relying on the new text.
A procurement example
A public agency evaluating an automated eligibility tool should check data-protection and administrative-law duties already applicable, regardless of the AI proposal’s fate. It can require bias evaluation, human appeal and incident reporting as contract terms today without incorrectly attributing those requirements to a still-pending bill.
