A French AI developer can build useful systems while complying with data protection obligations—but it must distinguish personal data in training corpora, lawful purposes, model extraction risks and user rights.
Start with CNIL’s actual materials
CNIL’s AI self-assessment guide and its January 2026 developer checklist address the development lifecycle under the GDPR. The authority treats AI Act obligations as a separate layer that may also apply.
Personal data may survive training
Removing obvious names from a dataset is not automatically anonymization. Evaluate residual identification and extraction risks, including whether queries to a model can reveal details about an individual.
Lawful basis is use-specific
Collection, preprocessing, training and a subsequent analytics service can have different purposes. A potential legitimate-interest analysis calls for context, expectations and safeguards; it is not a generic permission to scrape unrestricted personal data.
Design a rights process early
Users may exercise applicable rights even when systems are hard to modify. Trace data through stored corpora, labels, embeddings, evaluation records and model-related caches. Technical difficulty is a planning problem, not a reason to ignore requests.
Security beyond model behavior
CNIL recommends measures concerning access, infrastructure, development tools and verification against attacks. A general model safety benchmark cannot replace secure backups, authentication, privileged access management or routine vulnerability remediation.
Useful implementation record
Keep a source registry, lawful-basis assessment, DPIA decision, security test log, training transformations, user notices and human accountable owner. Verify the governing French and EU materials at release, not from a static checklist alone.
