Japan enacted an AI-related promotion law in 2025 and developed a government AI utilization agenda. That framework should not be mislabeled as identical to the EU’s risk-classification and enforcement scheme.
Check the instrument’s purpose
Japan’s Digital Agency describes the Act on the Promotion of Research and Development, and Utilization of AI-Related Technology as enacted in May 2025. Its official government AI program also refers to a December 2025 basic plan and emphasizes safe, secure use while promoting adoption. An AI promotion framework is not automatically a blanket approval of each private deployment.
Keep governance and compliance distinct
A national strategy may encourage research, innovation or public-sector use. Organizations still need to assess applicable privacy, intellectual-property, consumer, employment and sector-specific obligations. Avoid treating voluntary principles as the same thing as enforceable duties; document the exact statutory section before making a compliance claim.
Review the actual deployment
List who operates the AI, what decisions it influences, what content and personal data are processed, how users are informed and who can override errors. If a public institution uses AI for drafting, it should maintain source verification, data classification and records management appropriate to the function. The policy goal does not remove human accountability.
An illustrative use case
A local government drafts citizen-service explanations using an internal assistant. Public eligibility rules should be drawn from official, versioned sources; personal case records should remain subject to access controls; staff should review answers before publication. An official-looking response must not impersonate a formal decision made by a government officer.
Why comparison is hard
Japan, South Korea, Singapore, China and the EU use different instruments and terminology. Comparing whether each has an “AI law” without distinguishing promotion, advisory, transparency and high-risk obligations produces a misleading binary answer.
