An apparently convincing quotation from a court can be entirely fabricated. Legal research assistants are most useful as candidate-finding and drafting aids, never as substitutes for checking the actual governing authority.
Verify authority at the source
For every case, statute, rule or quotation confirm the jurisdiction, court, date, procedural posture, validity and exact quoted passage in an authoritative legal database or published opinion. A valid URL can still lead to the wrong proposition. Ask whether subsequent decisions overruled, limited or distinguished a cited case.
Keep research distinct from legal judgment
Search and summarization can reduce document review effort, but determining how authorities apply to facts requires professional judgment. An AI-generated answer can mix real propositions from unrelated jurisdictions or confuse proposed legislation with binding law. Mark unresolved questions, minority positions and exceptions explicitly.
Protect client confidentiality
Professional responsibility obligations do not disappear because a tool is popular or marketed to lawyers. The American Bar Association’s July 2024 Formal Opinion 512 discusses competence, confidentiality, client communications and reasonable fees. It is guidance grounded in US model rules, not a universally binding law or substitute for local bar requirements.
Adopt an evidence-based filing gate
Before sending advice or filing, a qualified reviewer checks every relied-on citation, exact quotation and procedural requirement and certifies that the document was reviewed. Keep the source version and lawyer’s disposition, not an unbounded archive of sensitive prompts. The system should never auto-file or assert that a legal conclusion is settled without verification.
Example and alternatives
A legal team uses an AI tool to locate authorities relevant to notice periods. It returns a candidate case and statutory section. The lawyer confirms the official text, effective period and controlling jurisdiction and removes an invented quotation. If authoritative databases are unavailable, return a research limitation rather than a guessed answer.
