The Nigeria Data Protection Act 2023 contains a definition of automated decision-making. That makes the actual role of automation and personal data more important than whether the product displays an AI logo.
Start with the enacted text
The Nigeria Data Protection Commission hosts the Nigeria Data Protection Act 2023. Its definitions include decisions based solely on automated processing without human involvement. A human reviewer who only rubber-stamps outputs may be inadequate in practice, but legal consequences depend on the specific provision and facts.
Identify the processing participants
Record who determines purposes, who processes data for others and who has access. Public-facing chat interfaces, internally hosted models and offshore APIs can pose different transfer, security and rights issues. Avoid importing GDPR terminology without confirming the Nigerian definition.
Make data provenance auditable
Separate scraped data, consented user inputs, customer records and purchased datasets. Document acquisition methods, relevance, retention and whether the model can reproduce personal details. Training under one purpose should not automatically authorize unrelated targeting.
Test human decision routes
For hiring, lending or service eligibility, determine whether a decision is made solely by automation, how users can challenge errors and whether staff can meaningfully reconsider the outcome. Keep versioned records without logging unnecessary personal information.
Do not invent exemptions
Regulatory registration, sector requirements and cross-border mechanisms need their own textual review. A global vendor certificate does not establish Nigerian legal compliance. Verify whether an implementing directive or guidance changed the analysis.
Use before launch
Run a local counsel/data protection review, establish privacy notices and incident response, assess suppliers, and test data subject request handling with realistic examples. Treat this guide as orientation, not a legal determination.
