Stable Audio Licensing: Commercial Use Is Not the Same as Exclusive Ownership

Stable Audio’s current license guidance is comparatively permissive about commercial deployments, but the freedom to use a file should not be confused with exclusive ownership of the composition or an indemnity from lawsuits.

What the provider states

Stability AI’s Stable Audio licensing FAQ says commercial use is permitted across the listed Free, paid and pay-as-you-go API routes subject to its Terms and Acceptable Use Policy. It describes permitted use in monetized videos, advertisements, applications, games and music distribution. These are contractual permissions, not a guarantee that every generated output is novel or that a particular retailer must accept it.

Hosted output versus self-hosted model

The same source draws a distinction between the hosted service and open-weight self-hosted models. Those models can have a separate community license with a revenue threshold and registration obligations. A publisher that moves from a subscription to self-hosting must review the model-specific license again. Do not copy a website subscription paragraph into a procurement signoff for a local model.

Who supplies the source audio?

The user remains responsible for avoiding infringement of others’ rights. If the workflow uses uploaded sample material, require evidence of the sample, composition and performance permissions. Similarity to a recognizable recording, protected lyrics or a famous singer can raise problems that a platform’s broad output permission does not eliminate. Keep a lineage record for reference tracks and edits.

How to evaluate a music generator

Specify mood, instrumentation, duration, intended placement and a forbidden-content list, then assess loopability, mix headroom, instrumental continuity and unwanted vocals. For podcast backgrounds, audition under speech at real playback loudness rather than solo headphones only. If the service exports stems, check that the current tier actually includes the needed format. Don’t publish invented listening tests or originality scores.

The business decision

Stable Audio can fit licensed production across video and interactive media when the documented terms align with the client. Enterprise indemnity and negotiated protection are separate commercial decisions. Store the applicable terms URL and date in the project archive and recheck them before mass distribution across jurisdictions.

Worked production example

An indie game developer can reasonably consider Stable Audio for ambient loops and sound effects, but should still distinguish interactive embedded assets from selling standalone sample libraries. Write down the proposed distribution channel and the exact service or open-weight model before procurement. If the development studio crosses a self-hosting license revenue threshold, that event may alter its license route even though the same weights continue to run technically. A plan comparison must therefore track business eligibility as well as output audio minutes.

Practical acceptance gate

Review prompts and reference audio for protected compositions, recognizable voice impersonation and embedded third-party samples. Keep original unprocessed masters for editing and run a loudness and loop-seam test inside the game engine or video editor. Store the dated hosted terms or model-specific self-hosted license in the build archive. Treat provider commercial permission as one item in a chain of title, not as an originality certificate or automatic indemnification against all third-party claims.
