Mexico’s private-sector personal data law was newly issued on 20 March 2025. AI project teams should not use compliance checklists written solely for the earlier 2010 statute.
Identify the correct instrument
The federal official legal repository publishes the new Ley Federal de Protección de Datos Personales en Posesión de los Particulares, dated March 20, 2025. The text is not an AI-only statute: its relevance starts where AI workflows process personal data.
Map each processing purpose
Distinguish input collection, model training, analytics, staff prompts, generated outputs and onward transfers. Record the lawful data-handling justification and notices applicable to the actual organization. A model provider and its customer may have different roles and contracts.
Automated outcomes deserve scrutiny
A ranking or recommendation may contribute to a decision affecting a person. Preserve factual evidence about data sources, accuracy, correction channels, alternatives and the human responsible for an adverse outcome. Technical audit trails support accountability without creating rights absent from the statute.
Cross-border provider risks
A foreign API location or vendor assurance does not itself settle Mexican transfer or disclosure questions. Examine actual sub-processors, storage locations, remote access, training reuse and retention. Privacy and information-security measures should follow the data rather than the marketing region.
Avoid outdated regulator references
The 2025 reform changed the legal architecture. Do not assume that older forms, agency names, procedures or exemptions remained identical. If quoting penalties or statutory articles, use the updated enacted text and related operative regulations.
Deployment decision
Conduct a Spanish-language law-and-data-flow review, provide an accessible privacy notice, minimize unnecessary personal data, and test rights workflows. Obtain local specialist review before announcing legal compliance across Mexican sectors.
Publication limitation
Additional verification remains open: Need full reconciliation of 2025 agency transition, current regulations and any 2026 changes. Do not represent this jurisdictional draft as a complete statement of current legal obligations until that review is finished.
