“Commercial use allowed” and “there is no rights risk” are different propositions. Creative teams need a defensible approval trail.
Scenario: A company licensing AI-assisted visuals for advertisements, packaging or resale distribution.
Scope and cutoff: Adobe policy and licensing sources current to 25 October 2026; non-Adobe provider terms must be evaluated separately for exact tool/tier.
Evidence standard: These are vendor documents, not independent product tests. Unavailable claims are left unknown; plan prices are delegated to the AI 10 dated price ledger.
Evidence matrix
| Option | What is established | Evidence |
|---|---|---|
| Adobe Firefly | Adobe specifies commercial-use conditions and distinctions for Adobe versus partner models | Official documentation |
| Adobe Stock AI submission | Official guidelines require appropriate model rights and identifiable-person releases | Official documentation |
| Other vendors | Individual terms and indemnities not independently verified in this guide | Unknown / not tested |
Why the vendor label is not a legal conclusion
Adobe’s AI Studio guidance describes a ‘commercially safe’ label for designated Firefly outputs and explicitly instructs customers to inspect the terms of partner models. Adobe also describes conditions for using Firefly output commercially. These are first-party policy statements; they do not override trademark, likeness, privacy, advertising or local consumer-protection rules. A purchaser should distinguish training-material representations, indemnification eligibility, source-asset licensing and rights in the final use case. Such questions should be escalated to qualified counsel for sensitive campaigns.
The contrast that matters
A design tool that includes a licensed stock image can have two separate pieces of paperwork: a license to use the source photograph and a policy on the generated transformation. For a model fed an uploaded celebrity photo, permission to use the editing tool does not grant publicity rights in the individual. Adobe notes that licensed stock originals can be edited within applicable terms, while third-party models can carry separate conditions. The correct decision is not to rank vendors by an undefined single word ‘safe’ but to list what is covered, what remains excluded and who takes residual risk.
A repeatable approval path
Before generation, the requester records the asset purpose, jurisdiction, channels, duration of use and whether a real person or recognizable brand appears. The designer lists each prompt input and any stock license. After generation, a reviewer checks for protected marks, identifiable people, misleading product depictions and unintended borrowed style. Retain the model/version, approved exports and a record of who signed off. For stock marketplace submission, read the receiving marketplace’s AI labeling and licensing rules rather than assuming the source model’s commercial terms are sufficient.
Choose based on the distribution risk
A low-risk internal slide illustration has different requirements from a global packaging image with an endorsement-like face. For the latter, procurement may value documented rights frameworks and indemnification eligibility, subject to actual contract terms. For concept boards, experimentation and flexible references may have a larger creative payoff. In either case, human review is indispensable. Price analysis belongs to AI 10 and should include clearance costs, rework and the chance that an apparently finished asset must be withdrawn.
What the decision depends on
Favor the option whose contractual terms fit the intended distribution, and clear rights on all reference assets; no blanket immunity is evidenced.
Buyer verification checklist
- Is source material licensed?
- Is model-specific indemnification actually in the signed contract?
- Is a model release required?
- Does the publishing venue allow the AI content?
What remains unknown
No independent hands-on scores, standardized ratings, guarantees of region-wide availability or current billable price comparisons are established here. Country, tier, device and actual contractual controls must be verified for the intended purchase.
